Really? REALLY? No danger at all? You own argumentation says that it
is an absolute requirement. You want us to require a patent
wavier. You also say in another context that we can't afford to WIN a
lawsuit (much less lose one). Thus we should avoid setting new law.
The BSD has no explicit patent waiver. It might have an implicit
one. Settling that issue would be setting new law. Thus, your own
logic demands that we deprecate the BSD OR that we give up on
requiring patent waviers. Are you having trouble following your own
logic?
