Hi Wayne. I understand that McCoy is an attorney. That doesn't necessarily
mean that attorneys are infallible. I myself am not an attorney, and I do
have a general understanding that I am perhaps lacking in intellect in
certain areas that he is well diverse in. However, I respectively disagreed
with his statement, especially in regards to how it complies with the OSD.
I seperated "or even used" with a comma, and this is a list. "even" also
adds emphasis as commercial usage might not be expected. I didn't use
and/or given uncertainty over the context and/or had
http://www.slaw.ca/2011/07/27/grammar-legal-writing/. Also "even" as an
adverb usually adds emphasis to something unexpected.
https://dictionary.cambridge.org/us/grammar/british-grammar/even The fact
that I seperated "or even used for commercial purpose" with a comma as with
the rest of the items of the list indicates this is one of the usages it is
allowed. I also stated prior " copied, modified, redistributed, published".
Since it doesn't indicate restrictions on how it can be redistributed or
published and didn't say only "for" instead of ",or even used for" then the
context of it being only for commercial purposes is a stretch and legally
hard to defend. Also I explicitly state in bold, "no claims are made in
regards to safety, security, warranty, usability, or other form of
merchantability and market-readiness" in regards to what is containing the
license. This is in regards to code and what is being licensed, I then
explicitly indicate in the following paragraph:
The context of this license includes: Keeping this original license text
verbatim and permissive notice, as well as the copyright notice included in
any redistribution of said project. Project is defined as what is using
this license.
So I believe I have any question in regards to uncertainty about the usage
of the license being only commercial already answered. I also make a
context stating that the license is required in regards to redistribution.
Outside of this, commercial and noncommercial are implied, and to my
understanding within the context of OSD.
I'm perfectly fine with criticism and responding to it. If I disagree
though, I state my ideas in regards to why I disagree. This is part of a
diplomatic process. Many of the same arguments in regards to usability were
already thought off prior to the making of this license.
