Dear Rod,

You make a fair point as university trademarks are protected by
definition whether someone is trying to appropriate them on baseball
caps or in software.  This was a key point in reaching agreement among
the four university legal offices as they wanted the extra notice
explicitly disallowing use of the name or the trademark.  

We want this to be a commercial friendly license and for anyone to
extend or package and sell the product.  We do not want any
misunderstanding about representing it as "the software from Stanford
and IU" etc.  This could probably be understood like the optional export
notice in some OSI licenses.  It is simply a notice more than a term of
the license.

Please do correct me if I've missed some other matter in your message.

I agree that the license complies with the OSD. I also agree that your
last
paragraph could be clearer. I suspect that you could even delete it.

without specific, written prior permission. Title to copyright in the
Original Work and any associated documentation will at all times remain
with
the copyright holders."

The rights referred to in the clause above are exclusive rights by
definition so permission is required regardless of inclusion of the
clause
in a license.  If a trademark is used in the license and I have
overlooked
it, then the clause *might* help.
