Actually, I don't think this is a hypothetical at all. It's an *explicit*
purpose of the CAL to enforce the data terms. The data terms must be
followed by *everyone* on the network *without exception,* or they fail to
achieve their purpose. How could you possibly make that happen? You gave me
the answer: You must use patents to enforce that everyone on the network
use CAL-licensed software. Thus, you must actively enforce against Open
Source under other licenses, which do not contain the data terms.

Can you show me a scenario in which the data terms applying only to
*some *nodes
would be OK, and would not subvert the entire purpose of the Holochain?
