While I'm not certain yet there's a problem here, I have the feeling
that 'Original Software' would have made more sense there than
'Subject Software' (a superset of 'Original Software').

I also question whether 'or any part thereof' is necessary and wonder
whether that could lead to some problematic consequence. Maybe it
would be better if the reference to 'any part thereof' were restricted
to 'Original Software'.
