I don't have an answer to this. But, I recently read Rami M. Olwan's
book "Intellectual Property and Development: Theory and Practice" (it's
pretty good). I don't know if he is on this list or not, but, he seems
pretty widely read on both international case law and legal theory as it
applies to FLOSS licensing. Surely someone on this list must know him,
maybe they could loop him in on the discussion?
