The best answer to your question, IMVAO, is "Mu":  OSI is not a public
institution devoted to making public pronouncements on other people's ethics.
The very notion that a non-profit institution devoted to being custodian 
of the Open Source Definition, and to open source community-building and
education, would have any business making such pronouncements strikes me
as extremely wacky.
