Nope, still won't fly: it still says that the names should (rather than
must) be used before permission is obtained.

Look, here's pseudo-code for what I think you want:

if (haveNoPermission) {
	if (useNames)
		illegal();
	else
		noProblem();
	}
else {
	if (useNames)
		noProblem();
	else
		illegal();
	}

That translates into English thus:

4.  The terms "Pronoic" and "pronoic.org" MUST NOT be used to endorse
     and promote products derived from this software without prior
     written permission.  If written permission is sought and obtained,
     the terms MUST be used to endorse and promote products derived
     from this software.  Permission can be obtained by writing to
     contact at pronoic.org.

Follow the logic.
