In some respects the laws are different, true. But there *is* a first 
sale doctrine in patent law; it's just called patent exhaustion.

I don't mind hearing opinions on what parts of this (or any other 
licenses) you or anyone else finds problematic, either in language, or 
in result, or under what your opinions are on what's open 
source/software freedom, but let's not misstate things in making your case.
