I think the legacy approval thing gets a general light touch.  I may have derailed things a bit by raising larger issues about the OSI approval and categorization process, using this license as an (unfortunately for you) example.
I do think, however, any approval should be contingent upon 3.0 being recategorized as "superceded" since it almost certainly has by 3.01.
The other issues are probably better left for a different time and a different process.
