You're right. I use that, too and have no problems with people who are doing that cause that can't cause problems by for example switching from gui to a command line software.

Yes, requiring preservation in notices in things other than the software isn't a restriction on the modification of the software itself. So that isn't a OSD 3 or 4 issue.

Echoing Tom on the pedantry, I wouldn't consider the 4-clause BSD a "badgeware" license. While It requires use of the organization's name in advertising, it doesn't put any restrictions or use, or absence of use, in the software itself.
