Says who? Legal basis for that conclusion?

They sure are! They are now in most FOSS licenses in one form or another.

Great, but now GPLv3 is apparently not compatible with GPLv2. :-) That's
unfortunate.
I frequently joke when I do something illegal as a driver that there is a
"Larry Exception" in the California Vehicle Code. It is much like the GPL
exceptions regarding license compatibility. They are the imaginary
constructs of the FSF.
