In what sense will they not enforce the licence?  I mean, if you came
into the possession of some software that didn't force you to read and
agree to a licence, what would such a court allow you to do?
Everything, as if it was CC0-licensed?  Nothing, applying penalties as
if it was "all rights reserved" (instead of any penalties the licence
might specify)?  Or would it apply some standard implied licence, or
what?
