Oggetto: Parere Licenza ?Falcon?
Ci viene richiesto motivato parere legale in merito al rispetto, da parte della licenza software ? Falcon programming Language?, dei parametri stabiliti da ?Open Source Definition?, ciò anche mediante comparazione ed eventuale analisi delle differenze con la licenza ?Apache? già approvata da parte della fondazione Open Source Iniziative (di seguito, per brevità?OSI ? Approved License? o ?Apache?).

La licenza di cui si richiederebbe l?approvazione (di seguito, per brevità, ?Falcon?) è, nei seguenti punti, identica alla OSI ? Approved License:
dall?inizio sino al 4° comma (incluso) delle ?Definitions?;
dal 6° comma fino all?8° comma delle ?Definitions?, inclusi;
il 12° ed il 13° comma delle ?Definitions?;
il punto 3 (Grant of Patent License);
il punto 4 (Redistribution of Work and Derivative works), commi 1, 2 e 3;
Dal punto 6 (Submission of Contributions) sino alla fine del documento.
Principali differenze riscontrate comparando i testi della Falcon e della OSI ? Approved License:
A)Rispetto 6° comma delle ?Definitions? della OSI ? Approved License le parole ?documentation surce, and configuration files? sono state modificate in ?example code?;
B)Rispetto all? 8° comma delle Definitions della OSI Approved License, nella licenza Falcon sono stati aggiunti i seguenti ulteriori 2 commi:
? Embedding works shall mean any work, whether in Source or Object Form, that links (or binds by name) to the interface of the work and derivative works.
Application of the work shall mean any work whether in Source or Object form, that is expressed through the grammar rules which are known by the work and that require the Work to perform its execution.?
C)Rispetto al punto 2 (Grant Copyright License) della OSI ? Approved License: immediatamente dopo le parole ?prepare derivative works of ? sono state aggiunte le parole ?prepare embedding works, prepare application of the work?;
D)Il titolo del punto 4, che nella OSI ? Approved License era ?Redistribution?, nella licenza Falcon è stato mutato in: ?Redistribution of Work and Derivative Works?;
E)La progressione dei commi al punto 4 è contraddistinta, nella licenza Falcon, dai numeri 1, 2, 3, 4, e 5 in luogo delle lettere a,b,c,d che la contraddistinguevano nella OSI ? Approved License;
F)Successivamente al punto 4, lett. C della OSI ? Approved License ? ora, nella licenza Falcon, punto 4 numero 1 - sono stati aggiunti i seguenti ulteriori commi (nn. 4 e 5):
?4. You must state in the Source Form and in the documentation of any Derivative Work the fact that such work is a derivation of the Work, and include a copy of the Work in its Source form or provide directions on how to obtain a copy of the Work in its Source form; and
5. The Derivative Works are distributed under the terms of this License, or under terms that do not cause infringement of this License.?
G) Sono stati eliminati, rispetto al testo della OSI Approved License, il punto 4 d) ed il comma finale del medesimo punto 4;
H) Il punto 5 (Submission of Contributions), seppur identico nel dato testuale, è, tuttavia ora contraddistinto dal n. 6, ciò in quanto è stato aggiunto il seguente nuovo punto 5:
?Distribution of Embedding Works and Applications of the Work. You may produce and distribute any Embedding Work or Applications of the Work thereof in any medium, in Source or Object form, provided You meet the following conditions:
1. The Embedding Works and Applications of the Work are distributed under the term of this License, or the application of another License is explicitly stated in the documentation of the Embedding Works and Applications of the Work or included in the Source form of the Embedding Works and Applications of the Work; and
2. If the Source form of Embedding Works is not distributed nor made available to the Users in any form, the Embedding Works carry a prominent notice in their documentation, or when not applicable, in any place that the Users are exposed to, about the fact that the Work is embedded, along with a general statement about the task that the Work is performing in the Embedding Works; and
3. If the Source form of Applications of the Work is not distributed nor made available to the Users in any form, the Applications of the Work carry a prominent notice in their documentation, or when not applicable, in any place that the Users are exposed to, about the fact that the Work is used by the Application of the Work.?
I) I rimanenti punti 5, 6, 7, 8, 9, della Osi approved License (Apache) sono rimasti identici ma ne è stata cambiata la numerazione in 6, 7, 8, 9 e 10.

E? ora necessario verificare se, alla luce delle differenze ora indicate ed evidenziate la licenza ?Falcon? rispetti e soddisfi i parametri delle Open Source Definitions stabiliti dalla fondazione OSI ? Open Source Initiative ovverosia possa venire considerata licenza Open Source.
I requisiti affinché una licenza possa essere definita open Source sono i seguenti:
1) Free Redistribution . The license shall not restrict any party from selling or giving away the software as a component of an aggregate software distribution containing programs from several different sources. The license shall not require a royalty or other fee for such sale.
2) Source Code. The program must include source code, and must allow distribution in source code as well as compiled form. Where some form of a product is not distributed with source code, there must be a well-publicized means of obtaining the source code for no more than a reasonable reproduction cost preferably, downloading via the Internet without charge. The source code must be the preferred form in which a programmer would modify the program. Deliberately obfuscated source code is not allowed. Intermediate forms such as the output of a preprocessor or translator are not allowed.
3) Derived Works. The license must allow modifications and derived works, and must allow them to be distributed under the same terms as the license of the original software.
4) Integrity of The Author's Source Code. The license may restrict source-code from being distributed in modified form only if the license allows the distribution of "patch files" with the source code for the purpose of modifying the program at build time. The license must explicitly permit distribution of software built from modified source code. The license may require derived works to carry a different name or version number from the original software.
5) No Discrimination Against Persons or Groups. The license must not discriminate against any person or group of persons.
6) No Discrimination Against Fields of Endeavor. The license must not restrict anyone from making use of the program in a specific field of endeavor. For example, it may not restrict the program from being used in a business, or from being used for genetic research.
7) Distribution of License. The rights attached to the program must apply to all to whom the program is redistributed without the need for execution of an additional license by those parties.
8) License Must Not Be Specific to a Product. The rights attached to the program must not depend on the program's being part of a particular software distribution. If the program is extracted from that distribution and used or distributed within the terms of the program's license, all parties to whom the program is redistributed should have the same rights as those that are granted in conjunction with the original software distribution.
9) License Must Not Restrict Other Software. The license must not place restrictions on other software that is distributed along with the licensed software. For example, the license must not insist that all other programs distributed on the same medium must be open-source software.
Analisi delle differenze emerse dalla comparazione dei testi.
Poiché è certo che la OSI ? Approved License (Apache License, Version 2.0., January 2004, http://www.apache.org/licenses/) rispetta la Open Source Definition per aver già superato con successo il relativo processo di approvazione da parte di OSI, si procederà di seguito, a verificare il rispetto dei suesposti parametri da parte della licenza Falcon con solo riguardo alle differenze riscontate alla OSI Approved License:
quanto alla differenza indicata nel presente parere con la lettera A), l?eliminazione delle parole ?documentation surce, and configuration files? e la loro sostituzione con le parole ?example code? è motivata unicamente dal fatto che la licenza Falcon, a differenza della OSI ? Approved License Apache, non è dotato di file di configurazione, esso infatti non è suscettibile di essere programmato bensì solo di essere configurato. La differenza in esame è stata dunque necessaria per adeguare il testo alle caratteristiche del software Falcon e non è in alcun modo incompatibile con le Open Source Definitions;
quanto alla differenze indicate nel presente parere con la lettera B), C) esse introducono nel testo le definizioni di ?Embedding Works? e di ?Application of the Work?. Tali definizioni non sono in alcun modo incompatibili con le Open Source Definitions e sono rese necessarie dal fatto che il software Falcon è congegnato per essere incluso in altri programmi, trattandosi di motore che permette alle applicazioni (già esistenti) di utilizzare un linguaggio di programmazione più semplice e di alto livello per una maggiore configurabilità durante l?esecuzione di applicazioni già esistenti;
quanto alla differenza indicata nel presente parere con la lettera D), essa è stata introdotta per rendere più chiaro al lettore, vista la nuova introduzione dei concetti di Embedding Works e di Application of the Work, che il punto 4 disciplina unicamente la ridistribuzione delle opere e delle opere derivate (e non anche degli Embedding Work e delle Application of the Work) e ciò è, certamente, conforme alle Open Source Definitions;
quanto alla differenza indicata nel presente parere con la lettera E), essa riguardando solo la disposizione/organizzazione del testo è irrilevante ai fini del presente parere legale;
quanto alla differenza indicata nel presente parere con la lettera F), i nuovi 2 commi introdotti sono coerenti con le Open Source Definitions, posto che mirano a che le opere derivate vengano distribuite alle condizioni previste dalla licenza e a che qualunque successivo utilizzatore di qualunque opera derivata, sia a conoscenza che si tratta, appunto di un?opera derivata e possa accedere al codice sorgente. Ciò è coerente con le Open Source Definitions;
quanto alla differenza indicata nel presente parere con la lettera G), l?eliminazione rispetto al testo della OSI Approved License del punto 4 d) e del comma finale del medesimo punto 4, motivata anche dalle aggiunte di cui alla lettera F) del presente parere lasciano invariata la corenza della licenza Falcon con i parametri della Open Source Definitions;
quanto alla differenza indicata nel presente parere con la lettera H), poiché, come detto, con il punto 4 della licenza Falcon, si è disciplinata la ridistribuzione dei Works e dei Derivative Works, è stato inserito il nuovo punto 5 per descrivere anche le possibili modalità di ridistribuzione degli Embedding Woks e delle Applications of the Work, il tutto sempre nel pieno rispetto della Open Source Definition;
quanto alla differenza indicata nel presente parere con la lettera I) essa, riguardando solo la disposizione/organizzazione del testo, è irrilevante ai fini del presente parere legale;

In conclusione, a seguito di approfondita analisi del testo della licenza Falcon, il sottoscritto legale esprime parere positivo nel senso del pieno rispetto della Open Source Definition.
