We could change our BSD License template to say this:

Note: the licensor may modify the warranty section using the text in
italics.

THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED <i>TO THE EXTENT PERMITTED BY APPLICABLE LAW</i>.
