I would say that notice was part of the licence, so there are now two 
licences, one with and one without such a statement.  What is probably 
needed is for the non-Afero one to include the Afero one as an 
alternative to using the same licence for derivatives.

Vague so doesn't meet the "clearly defined" objective.  This, and most 
of the rest only seem to apply to the Afero type variant of the licence.

I think you need to word many of them as general principles, followed by 
something like "Not withstanding the generality of preceding, this 
includes........". I'm not sure if "Not withstanding" is the right 
phrase here.
