But not necessarily under the MS-CL itself.  In particular,
he can use his own Section 3 terms, including a warranty disclaimer
and patent defense pointing to himself.  Only the person who distributes
unmodified source (under 3C) is stuck with the MS-CL itself, and there
is no reason for him to care, since he is simply a disseminator.

Further note that in 3A1, modified code needs to be distributed "along with
a copy of" but not necessarily "under the terms of" the MS-CL.
