Ernest,

The section related to distribution of modifications has been altered to 
remove any confusion between "Derivative Works" and "modifications" :

"3. You may make modifications to the Original Software and distribute 
your modifications, in a form that is separate from the Original 
Software, such as patches. The following restrictions apply to 
modifications:"

"modified versions of the Original Software" would be Original Software 
+ patches.

Also seperated the Miscellaneous section into 3 sections:

Jurisdiction, Venue and Governing Law. (Modified to remove Illinois and 
Cook County as location)
Attorneys Fees
Miscellaneous
