Nobody knows.  Specifically, nobody knows because copyright is a federal
matter, and it's not clear whether a contract (which is governed by state
law) can derogate from a right granted the public by the Copyright Act.
Courts have wavered on this one.

IANAL, TINLA, etc.  This argument doesn't apply outside the U.S.
