John, Thank you for your comments on the license. 

it is very much The Open Group's intention that this applies to the kernel
of the Operating System, we are not including any utilities in the
definition. While we are not at liberty to change the license, through
legal reasons, we will certainly endeavour to make this clear in the Q&A
associated with the release.
