Reasons for withholding approval: The subject matter of licenses is
“intellectual achievement protected by copyright law that is
licensed under This License, including but not limited to a written
work, a musical work, a fine art work, an architecture work, a
photographic work, an audiovisual work, a graphic work, and a model
work.” Because of the differences in the purposes and goals of these
different (albeit related) areas, open culture licenses are outside
the purview of the Open Source Initiative.<br>

2. 无其他许可<br>

除“本许可协议”明确规定外，“本许可协议”不提供包括商标、专利在内的任何其他许可。<br>

3. “传播”条件<br>

been extended to other types of works. We present two real
examples below:</div>

<div>- Example 1: users have been increasingly utilizing the
GitHub infrastructure to collaboratively create open tutorials
and learning materials, such as technical interview tutorials
(e.g., <a href="https://github.com/CyC2018/CS-Notes"
moz-do-not-send="true" class="moz-txt-link-freetext">https://github.com/CyC2018/CS-Notes</a>)
and programming materials (<a
href="https://github.com/lydiahallie/javascript-questions"

[see our research paper: Yao Lu et al., Studying in the
‘Bazaar’: an Exploratory Study of Crowdsourced Learning in
GitHub]. Many of these non-software projects have become as
popular as well-known software projects, especially that the
most-stars Java project in GitHub, CyC2018/CS-Notes, is a
non-software project.</div>

<div>- Example 2: Chinese designers (mainly for UI design) have
recently proposed the initiative of Open Design in 2022 (<a
href="https://view.inews.qq.com/k/20220509A04SIY00?web_channel=wap&openApp=false&pgv_ref=baidutw"
moz-do-not-send="true">https://view.inews.qq.com/k/20220509A04SIY00?web_channel=wap&openApp=false&pgv_ref=baidutw</a>).
The core values of Open Design are: open copyright, active
ecosystems, and collaboratively creating. These values stem from
the idea of open source and have made a significant impact in
the field of design: the popular Chinese design platform,
js.design (<a
href="https://js.design/community?category=explore"
moz-do-not-send="true" class="moz-txt-link-freetext">https://js.design/community?category=explore</a>),
has accumulated a considerable number of open design works, and
designers can easily create adapted works based on existing open
design works on the site.</div>
<div><br>
</div>
<div>Inheriting the idea of open source software, these works have
the following characteristics: a) open use, b) free
distribution, and c) allowing modification, which we call open
works. Like open source software license, open works license is
a format contract with legal effect that regulates and restricts
the copying, use, modification and distribution of open works.
With the extension of open source in practice, the concept of
‘source’ can be extended and explained as ‘source file’, so as
to include more types of works. We expect that the non-software
open licenses which conform with the spirit of open source and
can promote the development of open source can be included in
the OSI-approved licenses. We note that the OSI has already
approved licenses which are not purely for software, e.g., open
font (IPA and OFL-1.1) and open hardware (CERN-OHLs-2.0), which
we believe is in line with this trend.</div>

</div>
<div>2) We observe that right holders of open works present
requirement for granting patent license, which can be reflected
from the following two well-known cases:</div>
<div><br>
</div>
<div>- Case 1: In 2014, US electric car maker Tesla Motors Inc
opened its patents for all to use through a “Patent Pledge” (<a
href="https://www.tesla.cn/legal/additional-resources"
moz-do-not-send="true" class="moz-txt-link-freetext">https://www.tesla.cn/legal/additional-resources</a>).
The patents are mainly regarding to the manufacture of electric
cars. People can download and use the related patent files.
These files are textual works rather than software code.</div>

<div>- Case 2: In 2020, Medtronic opened design specifications for
the Puritan BennettTM 560 (PB560) ventilator to allow
innovators, inventors, start-ups, and academic institutions to
manufacture ventilators (<a
href="https://www.medtronic.com/us-en/e/open-files.html"
moz-do-not-send="true" class="moz-txt-link-freetext">https://www.medtronic.com/us-en/e/open-files.html</a>).
The design specifications are mainly design documents including
textual files and drawing files. These materials are licensed
under a special permissive license that is drafted by Medtronic
(<a
href="https://www.medtronic.com/content/dam/medtronic-com/global/Corporate/covid19/documents/permissive-license-open-ventilator.pdf"
moz-do-not-send="true" class="moz-txt-link-freetext">https://www.medtronic.com/content/dam/medtronic-com/global/Corporate/covid19/documents/permissive-license-open-ventilator.pdf</a>),
which contains the grant of patent license. This case is related
with the “Open Covid Pledge” and the “Open COVID License –
Patent and Copyright (OCL-PC)” (<a
href="https://opencovidpledge.org/v1-1-ocl-pc/"
moz-do-not-send="true" class="moz-txt-link-freetext">https://opencovidpledge.org/v1-1-ocl-pc/</a>),
which also refers to granting patent license.</div>

<div>Additionally, the posted UI designs in the Example 2 in
section 1) may also refer to granting design patent license.</div>

<div>Therefore, open works license should keep with users’ new
requirements and include terms of granting license of patent
covered by the copyrighted portion of the open works.</div>

<div>Distinguish:</div>
<div>As the name suggests, Mulan OWLs can be applied to general
works under copyright law, so there is no existing OSI-approved
license to directly compare and contrast it with. The set of
licenses, of course, can be used for software (but not
suggested) and thus are probably most closely comparable to
Apache License 2.0, BSD 3-clause License and Mulan PSL v2.
However, these licenses are not suitable for other types of
works.</div>

<div>Overall, the main charateristics of Mulan OWLs v1 are
summarized below:</div>
<div>- The licenses are applicable for open works (as explained in
section 1));</div>
<div>- The licenses include two licenses that grant patent license
(MulanOWL BY-PL v1 and MulanOWL BY-PL-SA v1);</div>
<div>- The licenses provide conventions of attribution for
multiversion works, which facilitates the use and retrieval of
works that are frequently modified, such as the crowdsourced
works mentioned in Example 1;</div>
<div>- As with Mulan PSL v2, Mulan OWLs are written in both
Chinese and English, which have the same legal effect. In case
of divergence between the Chinese and English versions, the
Chinese version shall prevail.</div>

<div>Legal review:</div>
<div>As with Mulan PSL, Mulan OWLs v1 were drafted by experts and
lawyers from colleges, research institutions, enterprises and
open source foundations. The lawyers are open source legal
experts specialized in the field of intellectual property and
open source software. Furthermore, the licenses have also been
reviewed by two third-party law firms on and an open source
legal expert in a company to ensure the license quality in
legality and written. </div>

<div>Proliferation category: Other/Miscellaneous licenses. Mulan
OWLs do not fall neatly into any non-other category:</div>
