I am submitting the Free Archive License (FARCL-1.0) for official approval.
This license was born from the urgent need for digital preservation in the
animation and software communities, specifically to address the
"End-of-Life" (EOL) crisis of proprietary formats.
1. RATIONALE
While established licenses like MIT or ISC are excellent for general
software, they lack a specific mandate for technological migration. In the
context of preserving culture trapped in closed binaries (such as legacy
Flash .FLA files), we need a legal tool that conditions the right to use
the work upon its transformation into functional source code. FARCL-1.0
bridges this gap by mandating that "Source Code" is the only valid
distribution format, ensuring long-term interoperability.
2. COMPARISON WITH OTHER LICENSES
FARCL-1.0 is a hybrid evolution. It uses the permissive core of the ISC/MIT
licenses but integrates the Attribution Assurance License (AAL) principles.
This is vital because, in digital archeology, the Archivist/Recreator
provides a significant technical contribution (the reconstruction of logic
and assets) that must coexist with the Original Author's credit.
3. OSD COMPLIANCE
- OSD #2 (Source Code): FARCL-1.0 is "Source Code Mandatory." It prohibits
proprietary binaries in the final archive, fulfilling the OSD requirement
that the source code must be the preferred form for modification.
- OSD #7 (Not product-specific): The license has been refined as a
general-purpose tool. It applies to any reconstruction of proprietary data
into open code, regardless of the technology stack or specific product.
4. LEGAL SAFETY (THE DISCLAIMER)
To encourage community participation in high-risk preservation, we have
integrated the Daniel Veillard (libxml2) disclaimer. This provides robust
protection for volunteers, stating they "accept no responsibility in any
conceivable manner" regarding the technical state or safety of the rescued
works.
CONCLUSION
We believe FARCL-1.0 is essential for the future of digital archives. It
transforms "closed media" into "open software," ensuring that our digital
history remains human-readable, editable, and free for all.
