Unfair?  I think that's a very minor risk compared to the risk of tying our hands
and being unable to correct our own past mistakes.

I don't have an object-level opinion about the particular license at issue.
I do thinmk this meta-level argument should be rejected.

It's a good look for OSI when, having determined that we made an
error, we own up to it and correct it.
