Are you sure of that? It seems to me the data sharing terms are required
performance, and contractual in nature (not simply rights in copyright
law). The theory that the user already owns the data is a red herring, they
don't have a right in law to request a copy until these license terms come
along.
So, we get a result like "if you refuse to convey certain data, you can't
publicly perform the program". This is a compulsion that goes pretty far
beyond "you must share the source code and the right to use, modify, and
redistribute".
