Yes, I think that's a very good point.

Hmm, except that it gets sticky where each individual contributor to the
same project chooses differently. That would be impossible to sort out
in a lawsuit.
So I'm back to just picking Chinese as the controlling language.
This demonstrates why it's so hard to write a good license and why they
can get very lengthy.
