Concerning OSD conformance please see for the discussion at 
http://projects.opensource.org/pipermail/license-discuss/2013-November/001358.html.

#3: It does clearly allow derived works; shielding of copyright notices 
does not contradict this.
#5: Additional facilitation in certain use cases does not discriminate 
against people or groups of people.
        Please do also read the argumentation at license-discuss about it.
