Is there even equitable estoppel by acquiescence?  The fall back 
license grants only permissions for "Copyright and Related Rights" 
and in 4b explicitly disclaims patent license:

"No trademark or patent rights held by Affirmer are waived, 
 abandoned, surrendered, licensed or otherwise affected by 
 this document."

As a thought experiment, would the OSI accept an otherwise permissive
license (MIT/BSD template) plus 4b be to compliant with OSD #7?
