You can also require that the creators of derivative works make a 
similar patent grant to yours. Which would make the Open Source folks 
happy while giving the commercial folks even more reason to commercially 
license.

Hm. I guess nobody has worked out the maximally-restrictive Open Source 
license. Oops, I've created a monster.
