It's compliant, but that doesn't mean the OSI should approve it.

This requirement will make enforcement very difficult.  If I see that a
fly-by-night operation has started distributing without source code, I
have to wait 12 months to see if they start providing source.  By that
time, it could be impossible to contact (or serve) them.

This doesn't require that the source of the derivative work is provided,
while I believe you intend that this is a requirement.
