Under 252.227-7014, if the software was not developed exclusively with Gov’t funds, the Gov’t has unlimited rights 5 years after the last contract mod and could release under ARL OSL.  Before then and devoid of other clauses, the contractor would be able to assert copyright and release as OSS.  DFARS 252.227-7013 pertains to data, specifically not software, but is framed the same.

If it was developed exclusively at private expense, the Gov’t has limited rights and cannot release.  In that case, it’s up to the contractor.
