You seem here to be saying "Let's not worry about it.  You'll get sued,
or you won't.  There's no perfect answer, so don't bother trying to come
up with somewhat better answers."  I'm pretty sure that's not what you
actually mean to convey, but it's what your statements really seem to
mean in the context of the questions raised.

I think "Laymen being afraid to use or develop software" is a bigger
problem.
