This license is not an Open Source license, because it contravenes Clause
1 of the Open Source Definition <http://opensource.org/osd-annotated>:

The license shall not restrict any party from selling or giving
away the software as a component of an aggregate software
distribution containing programs from several different
sources. The license shall not require a royalty or other fee
    for such sale.

> Signing of the Contract
>
> The license will take effect upon signing personally by the license provider
> and the licensee. The signature owner is required to be authorized to sign on
> behalf of the legal person.

In addition, this license contravenes Clause 7 of the Open Source
Definition:

The rights attached to the program must apply to all to whom
the program is redistributed without the need for execution of
an additional license by those parties.

that is not wittily expressed. John Cowan
