Are you saying that a sale with consideration has no implications for
statutory warranties?
A smart small publisher of commercial software will provide their users
will a reasonable warranty, taking into consideration the complex nature
of software. Their big customers will insist.
Larger software vendors try to word their EULAs in FOSS-like "as is" terms,
but in many jurisdictions they can't dodge merchantability requirements.
