I think that rule 5(1) is general to every mailing list or public area on
the Internet BY DEFAULT (unless otherwise permitted explicitly); this is a
RFC/BCP standard named netiquette.
So nobody has to see it and accept it before posting. This is a rule that
applies automatically.
But if a mailing list further restricts the default rules (notably the
topic), this MUST be presented to users before they accept it.
Rule 5(1) states nothing about the acceptable topics, it just reaffirms the
RFC netiquette. If this rule is not explicitly presented to the user when
he subscribes, the applicable terms are those from the RFC netiquette.
If you want to enforce more rules, the acceptation message sent to the user
MUST include the reference to the ToS explicitly. This is not the case, so
the subscriber knows nothing else than the RFC netiquette;

Service: http://opensource.org/ToS
Under section 5(1), you agree to not:

defamatory, vulgar, obscene, libelous, invasive of another's privacy,
hateful, or racially, ethnically or otherwise objectionable or harm minors;
I read your response as harrasing, and the response of the recipient shows
that it was taken as such. Politics may inform how we understand and
discuss licenses, but disparagement of another's political system is beyond
the scope of the list. If you insist on violating our terms of service, I
will insist that you be removed from this list.
