When to evaluate dual licenses

The common dictionary
meaning of "or" is that it presents a choice.  OSI is not
in the business of certifying choices of licenses, aka dual licenses,
as being OSD-compliant. If you continue down this path,
you could just as well end up concluding SW which is dual-licensed 
GPL or proprietary isn't really open source.  Up to you,
but I doubt many people will follow you there.

Please re-read the original scenario.  The point is that it is
not hard to construct a case where the recipient
(Carol) has a legitimate need to know if a distributor (Bob)
has made a choice of licenses.  Note the word "forced" does
not appear.
