Yes, and that would leave three relevant choices for the offending party.

a. Stop distributing the infringing software.
b. Settle with the copyright holder, by agreeing to release source code
under the GPL.
c. Settle with the copyright holder, by arranging an alternative
licensing arrangement

If either a. or b. is chosen, the purposes of the GPL are satisfied.  If
c., at least the copyright holder is satisfied.
