Apache License in Code

Hi

I have a pretty basic question on the distribution and development of 
code and it's licensing.

Let's say someone is working on a software project and a License get's 
commited into the cvs into the code they are working on. Now
all of the people working on that project have this open source license 
as they have updated their CVS. The license (Apache 2.0)
is now in everyone's code and the person who put the License in their 
works for one of the copyright holders. Is this act of commiting a 
License to cvs knowing that others will download it an act of 
distribution of the code and License by the copyright holder?
