That is not true (at least under one interpretation of the conditions),
because the restriction he suggests would only apply if it were being
distributed in a manner already prohibited under the (say) GPL - I am
reading "software that is sold" as "software that is sold without its
source code being made available for free". Think about (for instance) dual
licensing - see earlier post.
