Tina,
a similar case has been discussed here in the past few days: look
for MrNet in the archives. The bottom line is that while the term
"open source" does not enjoy strong legal protection, a polite
note calling attention to the fact that the term does have a widely-
accepted definition can work wonders.
You'll also see that Going To The Media (tm) was proposed and
rejected as a first approach: softly softly did it.
