According to our esteemed fellow list member, Rod Dixon, J.D, LL.M., a
lot of these licenses are indeed held to be actual contracts by the
courts. I would have to respectfully disagree, and assert that it
impossible for an agreement to exist between myself and a licensor when
that licensor is totally and completely ignorant of my very existance,
let alone my usage of any of his software.

My opinion is that it is legal to disagree with an EULA and to
instead follow normal copyright. Prudence suggests otherwise if you do
not have a rebellious streak.
